A BILL to amend article two, chapter twenty-four of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
nineteen, relating to requiring airline carriers operating in
West Virginia to provide "proof of financial responsibility".
Be it enacted by the Legislature of West Virginia:

That article two, chapter twenty-four of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
nineteen, to read as follows:
ARTICLE 2. POWERS AND DUTIES OF PUBLIC SERVICE COMMISSION.
§24-2-19. Airline carriers' proof of financial responsibility.

An airline carrier operating in this state shall provide proof
of financial responsibility to the commission to verify the ability
of the airline carrier, in the event of accident arising out of the operation of the airline carrier,
to respond in damages for
liability in the amount of five hundred thousand dollars because of
bodily injury to or death of one person in any one accident and,
subject to the limit for one person, in the amount of three million
dollars because of bodily injury to or death of two or more persons
in any one accident.

The commission shall propose rules for legislative approval in
accordance with the provisions of article three, chapter
twenty-nine-a of this code
to monitor airline carrier compliance
with the requirements of this section and to otherwise implement
the provisions of this section.

NOTE: The purpose of this bill is to require airline carriers
operating in West Virginia to provide "proof of financial
responsibility".
